Enduring Power of Attorney Explained

An Attorney appointed under a Power of Attorney can act on the Appointor’s behalf in a wide range of legal and financial matters. This includes accessing bank accounts, buying or selling property and shares, and managing superannuation—essentially, anything the Appointor could legally do themselves.

The Attorney is legally obligated to act in the best interests of the Appointor and can be held liable for any misuse or abuse of the powers granted.

An Enduring Power of Attorney remains in effect even if the Appointor later loses the mental capacity to make decisions independently.

The appointment can take effect immediately, at a nominated future date, or upon certification by a medical practitioner that the Appointor requires assistance managing their affairs.

Multiple Attorneys can be appointed either jointly—meaning all must agree on each decision—or jointly and severally, allowing any one Attorney to act independently of the others.
