What affect does an AVO have on a parenting case?

An AVO can have a significant impact on a parenting matter.

Family violence is treated very seriously by judges and can be the reason that you do not see your kids.

AVO’s are becoming a lot more common and are there to protect people.  However, some people accept an AVO as they cannot afford to retain a Solicitor and fight it.

There have been cases where the reasons for the AVO were completely denied but they accepted anyway.  This then went against that person in their Family Law matter as the Court only accepted the evidence of one of the parties despite other numerous issues in the matter.

Although alleged violence should always be treated seriously, the police do not always investigate the facts.

It is vital that if you are going through a separation with children involved that you seek legal advice on any AVO matter before accepting the terms.
