There are 2 broad types of challenges that may be made against Wills.  They are –

  • The Will is invalid because of –
    • Lack of Testamentary Capacity; or
    • Coercion, Duress or undue influence; and
  • A Family Provision Claim.

There is no time limit to challenge an invalid Will but there is a strict time limit of 12 months to commence Court Proceedings for a Family Provision Claim.
